Tom Cruise and Katie Holmes Split

After five years of marriage, Tom Cruise and Katie Holmes confirm exclusively to People they are getting a divorce.

"This is a personal and private matter for Katie and her family," says the actress' attorney Jonathan Wolfe. "Katie's primary concern remains, as it always has been, her daughter's best interest."

Tom's rep also released a statement on Friday on the actor's behalf: "Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children.  Please allow them their privacy."

Katie was noticeably absent from Tom's Rock of Ages premiere in Hollywood, currently living in NYC with their daughter, Suri, 6 (she is pictured still wearing her wedding ring on Wednesday, June 27).

Tom, 49, and Katie, 33, wed in a romantic ceremony in a castle in Italy in November 2006.

The news comes after the actor, who turns 50 on July 3, recently revealed he has no plans to expand his family: “I’m so happy with three."

“I’m enjoying every second with Suri that I have,” he adds. “And I’m enjoying the relationship with my older kids, and the way it is right now.”
